Another Family Plans to Sue D.R. Horton

Daniel Island resident Benjamin Allen plans to sue mega home builder D.R. Horton. That brings the number of lawsuits against the company to at least four.
The Allens say D.R. Horton used shoddy construction practices when building their home back in 2000. They say their home is so contaminated with mold that they are not able to live there anymore. The Allens moved from their home in May.
D.R. Horton's response to the family’s claims:
"D.R. Horton, Inc. previously stated that it would have the Allens’ house inspected by a certified industrial hygienist and then offer to perform any work recommended by the hygienist. We have done exactly that. In short, we have asked for a chance to repair the problem, and we have even offered to allow the Allens to approve the contractors that will be used. Nevertheless, the Allens have chosen to reject Horton’s offer and deny us the chance to help them get back into their home."
The Allens say they are disappointed with the company’s offer and have given a counter-offer of their own, but D.R. Horton did not agree to those terms.
“I think that statement is a creampuff statement. It has no significant substance to it. We’re looking for a real meaningful offer and D.R. Horton has not given us that. That has forced us to file suit,” the Allen’s attorney, Patrick McDonald said.
The lawsuit also names the company that inspected the Allens’ home before they moved in. Patrick McDonald says the suit is based on what he claims is D.R. Horton’s negligence and the personal injury the family has suffered.
“We sincerely hope that D.R. Horton will eventually accept responsibility for its faulty construction and step up to do the right thing so my family can put all of this behind us,” Joy Allen said in a written statement.
Benjamin Allen and his three year-old daughter Madeleine have just been diagnosed with asthma.
