Georgetown County Sheriff's Investigators charged a 12-year-old from Georgetown on April 25, 2008 for Assault and Battery with the Intent to Kill. The charge came after an investigation into an incident that occurred on April 22, 2008 in Georgetown.

Georgetown County Sheriff's Deputies responded to a residence on Nushell Road in Georgetown on Tuesday, April 22, 2008, for a 7-year-old victim that was shot with a BB gun. During the evening of the incident, sheriff's deputies were told the 7-year-old and the 12-year-old was playing in the yard when the 12-year-old picked up a BB gun that was left in the yard by the victim's brother. As he picked up the gun to throw over his shoulder, he accidentally pressed the trigger causing the gun to fire striking the victim in the eye.

During the investigation, sheriff's investigators found that the victim, the 12-year-old, and the victim's brother were in the back yard playing. The 12-year-old and the victim's brother were shooting the BB gun and the victim's brother went inside leaving the BB gun with the 12-year-old. Allegedly the 12-year-old told the victim he would shoot her with the BB gun at which point he pointed the gun at her and shot.

The 12-year-old was transported to the Department of Juvenile Justice in Columbia, SC on April 25, 2008. On April 28, 2008 he was returned to Georgetown for a detention hearing in Family Court where he was released in the custody of his parents. The victim was transported to the Georgetown Hospital by EMS and later transported to MUSC for additional treatment.
